PRIVACY AND TERMS

1.  Introduction: The Christian Family Online in America, Inc., is a 501(c)(3) public charity founded on April 20, 2000 by J. Owen Allen, Ph.D.  It is also referred to as “Christian Family Online” or “CFO” in this Contract.  CFO was granted permanent status as a public charity by the Internal Revenue Service on March 23, 2005.  CFO is the sponsor of this Website; the Book Saving Christianity; and the “Saving Christianity” Podcast; and the “Saving Christianity” retreat experiences; as well as all of the meetings, conferences, and small groups which it conducts; and CFO is the party with whom you are contracting.  Before using any of the teaching resources of this Website, The Book, The Podcast, or The Experience, read the following Privacy and Terms carefully.  By accessing/using any of these resources, either through the Internet or through face to face meetings, you are agreeing to these terms of access and use, and they constitute a legally binding Contract between you and The Christian Family Online in America, Inc.  By accessing and/or using any of these resources, you are acknowledging that you have read and understand the terms of this Contract, and that you agree to comply with them.  If you disagree with any part of this Contract, you must not access/use any of these resources, and you must discontinue use of any of the resources you have downloaded or copied from these resources.

2.  Children’s Online Privacy Protection Act (COPPA):  All of the resources on this Website, and in The Book, The Podcast, The Experience, Fellowship Meetings, and Small Groups sponsored by CFO are being offered to the public on the Internet and in face to face meetings only to users/participants who are 13 years of age or older.  Users/participants who are under the age of 13 must be accompanied by a parent or legal guardian.  If you are using/participating in these resources and are not yet 13 years of age, you must immediately cease such use and/or participation.  CFO does not, and will not, knowingly collect or maintain any information collected online or face to face from any child under the age of 13; nor does it provide or maintain any materials for children under the age of 13.  If you continue using/participating in any of these resources, you are representing to CFO that you are in fact 13 years of age or older.  If you are between the ages of 13 and 18, you are representing to CFO that you are either an emancipated minor, or that you have obtained the legal consent of your parent or legal guardian to use/participate in these resources, and you are representing to CFO that you are using the resources by participating in, or submitting comments, emails, or other information to, the resources in full compliance with the terms of these Privacy and Terms; and you are representing to CFO that you are fulfilling all of the obligations and responsibilities to the resources through and by the terms and conditions of this Contract.  Regardless of your age, if you disagree with any part of this Contract, you must immediately cease using the resources, and you must immediately discontinue the use of any of the resources you have downloaded or copied.

3.  Information Collected:  CFO’s Website, Book, Podcast, and Retreat Experience only collect the personal information that you volunteer while using/participating these resources.  Your personal information may be required when you submit a comment; or subscribe to email notifications; or when you subscribe/use/participate in any other CFO service, activity, or resource.  You may also be asked to give your age and country of residence to comply with applicable domestic and international laws.  Finally, CFO will collect your credit card information when you submit a tax-deductible donation to the Corporation.  However, your credit card information will only be used to process the donation, and then will be automatically deleted from the CFO system.

4.  Data Security:  CFO uses all appropriate electronic and administrative techniques to safeguard the confidentiality of your personal information; including Secure Sockets Layer (SSL) encryption, software firewalls, and other such techniques to protect your information and your tax-deductible donations to the Corporation.  CFO will take all reasonable precautions to protect your information and your donations from all forms of loss, misuse, or alteration.  However, no data transmission over land lines or Wi-Fi networks is one hundred percent secure.  Thus, while CFO will strive to protect your information and donations in every possible way, it cannot unconditionally warrant that they will be secure.  You therefore admit and agree that you are accessing/using this Website and CFO’s other resources at your own risk.  However, when you do access/use this Website and CFO’s other resources, CFO promises to make every commercially feasible effort to ensure the security of your information and donations.

5.  Data Sharing:  CFO will not distribute, lend, sell, publish, or share any of your personal information in any manner whatsoever without your prior written permission.

6.  U.S. Processing:  This Website, and the other resources mentioned in these pages, are hosted, sponsored, and operated by The Christian Family Online in America, Inc., in the United States of America.  By providing personal information to this Website and CFO’s other resources, all users, including users in Mexico, Canada, England, the European Union, and all other countries, nations, and territories outside the continental United States, are admitting that they understand and unambiguously agree with the intent and meaning of these Privacy and Terms conditions.  In addition, by accessing/using this Website and CFO’s other resources, and/or providing personal information to these resources, you consent and agree to the collection, transfer, storage, and processing of that information to, and within, the United States of America.

7.  Trademarks and Copyrights:  By accessing/using any of the resources on this Website and CFO’s other activities, events, and programs, you agree to honor all trademarks and copyrights covering those resources; and, except as permitted by the United States Copyright Act of October 19, 1976, with Amendments (see Public Law Number 94-553, 90 Statute 2541); and by Chapters 1-8 and 10-12 of Title 17 of United States Copyright Law, with Amendments enacted by Congress through June 30, 2016; and under the terms of the Digital Millennium Copyright Act (DMCA) enacted by the United States Congress in October, 1998; you agree not to print, publish, reproduce, store in a database or retrieval system, distribute, or transmit in any format by any means (including, but not limited to, digital, electronic, mechanical, electro-mechanical, photocopying, recording, scanning, or any other means), any of the resources on this Website, or The Book, or The Podcast, or the Experience, including photographs, recordings, videos, films, PowerPoint slides, and all other such information and materials, without the prior written permission of The Christian Family Online in America, Inc., the owner of the trademarks and copyrights.  You may not use frames, screen captures, or any other framing technique to enclose any trademark, logo, photograph, recording, video, film, slide, or any of the other proprietary information on this Blog and Podcast (including images, slides, texts, content, page layouts, forms, and all other formats), without prior written permission from CFO.  (See Clause 25 of this Contract for the address to which to ask for such permission.)  However, these copyright and trademark prohibitions do not prevent registered and/or subscribed users from routine participation in the materials on this Website, or in The Book, The Podcast, and The Experience; nor will these prohibitions prevent reviewers from brief quotations embodied in critical reviews, or certain other noncommercial uses permitted by Copyright Law.

8.  Terms of Access and Use:  “Access and use” of this Website, The Book, The Podcast, and The Experience are defined as any and every time you access them in any manner, by any means (including, but not limited to, by computer, tablet, iPad, iPhone, or any other device; or by any digital, electronic, or electro-mechanical technology), in any effort to view the Website, Book, Podcast, and Experience; link to them; link from them; or otherwise interact and/or communicate with them, and/or with any of their other users.  This includes, but is not limited to, submitting comments and questions to the Website, Book, Podcast, or Experience; making tax-deductible donations to the Corporation; sending texts, emails, or social media messages to the Corporation; or by participating/attending any other activity, program, or service that CFO establishes now, or may establish in the future.   Further, CFO only makes these resources available to you within the limits of the following terms of access and use:

a)  CFO’s Website, Book, Podcast, and retreat Experience are provided to you only as a public service and public charity for your convenience, inspiration, education, and encouragement.  The Christian Family Online in America, Inc., is not a counseling, psychological, psychiatric, medical, or therapeutic service, and assumes no liability for the content of its resources; or any meeting, conference, or teaching that it hosts or sponsors.  CFO gives no expressed or implied warranty that by accessing, using, or participating in CFO’s resources, or any CFO event, activity, product, or service, that you will benefit emotionally, physically, medically, psychologically, Spiritually, or any other way.  And CFO does not warrant, or represent, that any of its resources, materials, photographs, recordings, videos, films, content, slides, ideas, suggestions, concepts, Bible paraphrases, or Spiritual principles, offered and/or implied on it’s Website, or in its Book, Podcast, or retreat Experience are accurate or complete; or that they are up-to-date; or that the CFO has any duty to update them; or that such Content is free from technical inaccuracies or typographical errors; or that such content is free from changes caused by third parties; or that your access to, or use of, such content can be, or will be, free from interruptions, errors, computer viruses, or any other harmful issue.

b)  CFO is providing these resources to you on an “As Is” basis; and CFO disclaims any and all warranties of these resources, including, but not limited to: All teaching resources, content, photographs, recordings, videos, films, slides, software, activities, principles, services, or programs made available on, or accessed through, its Website, Book, Podcast, and Experience. CFO is also providing these resources to you on an “As Available” basis; and neither CFO, nor any affiliated or related entities, nor any of CFO’s directors, officers, employees, or agents, makes any representation or warranty of any kind as to the resources, content, photographs, recordings, videos, slides, films, software, activities, principles, services, or programs accessed/used in, by, or through these resources; or in, by, or through, any meeting, teaching, retreat, service, program, event, or activity linked to a third party; and/or for any breach of security associated with the transmission of information in, by, or through these resources; or in, by, or through any other Internet website linked to these resources.

c)  CFO and its affiliated or related entities, directors, officers, employees, and agents disclaim any and all expressed or implied warranties; including, but not limited to, non-infringement, quiet enjoyment, quality of information, and merchant ability or fitness.  This disclaimer includes any and all loss of data or profit arising from a use of, or an inability to use, any of the content on this Website, or in CFO’s Book, Podcast, Experience; or any CFO meeting, event, conference, teaching, or retreat.  CFO does not warrant that defects in the content or software of these resources can be, or will be, corrected; or that these resources and any server that makes them available, is, or can be, free from viruses, malware, or other harmful issues.  In no event will CFO or its affiliated or related entities, directors, officers, employees, and agents be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising from, and/or directly or indirectly related to, the accessing/using these resources, even if CFO and its affiliated or related entities, employees, and agents have been advised of the possibility of such damages.

d)  You may post and/or submit personal suggestions, ideas, questions, images, slides, recordings, videos, comments, and other information to this Website, or CFO’s Book, Podcast, and Experience by Email, Text, Tweet, USPS Mail, Facebook, Instagram, LinkedIn, YouTube, and/or any other Social Media, process, or service, that is known now, or that will be developed in the future, so long as such communications and/or submissions comply with the terms of this Privacy and Terms Contract.  CFO does not, cannot, and will not, pay for, or provide any consideration for, your communications and/or submissions as described herein.  Further, such submissions or communications relating to improvements in, or changes to, these resources or any CFO face to face meeting – including additions, corrections, deletions, or changes to the data and content of the Website, Book, Podcast, and Experience – whether provided by CFO or by you, are the property of CFO.  And under the terms of this Contract, you hereby assign all rights, title, and interest in, and to, such additions, corrections, deletions, or changes to The Christian Family Online in America, Inc., the host, sponsor, and operator of this Website, and The Book, The Podcast, and The Experience.

e)  You are solely responsible for any and all content, materials, and personal information, whether publicly posted or privately transmitted, that you submit to this Website or to CFO’s other resources. CFO is under no obligation of confidentiality; nor will it accept any liability for any accidental, unintended, or third party use or disclosure of your personal information, content, materials, photographs, recordings, videos, or other data.  You hereby grant to CFO and its directors, officers, employees, agents, and affiliates a non-exclusive, fully-paid, royalty-free, perpetual, irrevocable, worldwide, unconditional, unrestricted, and transferable license and sublicensable right to use, store, host, cache, maintain, broadcast, webcast, podcast, mobile-cast, transmit, tag, track, reproduce, edit, format, reformat, link to and from, modify, adapt, publish, translate, delete, create derivative works from, combine with other content, distribute, display, categorize, and/or otherwise use, reuse, and/or otherwise exploit such content, materials, and information, and any names, likenesses, recordings, voices, videos, photographs, images, digital recordings, performances, and any and all other personal ideas, concepts, feedback, or data included in your personal content, materials, photographs, and information, in any manner, medium, or content delivery technology, now known or hereafter devised, for any purpose, as determined solely by CFO, and at its sole discretion, without the requirement for any compensation to you or anyone else, or the need to require additional consent from you or anyone else, or the need to provide prior notification or credit to you or anyone else.  You further grant CFO the right to pursue at law or equity any person or entity who/that violates CFO’s and/or your rights to your content, materials, and information.  You also agree that any personal content, materials, photographs, recordings, videos, films, and information that you provide to this Blog and Podcast, and/or to any CFO face to face meeting will be covered by the license granted herein.  However, nothing contained herein will be deemed to transfer to CFO, or to any of its directors, officers, employees, agents, or affiliates, any ownership rights in, or to, your personal content, photographs, materials, or information.

f)  You agree not to transmit to, or distribute in, these resources any content or material that violates any right of any third party; including, but not limited to, the copyright, trademark, privacy, or other personal and/or proprietary rights of any person or entity.  In the event that you do transmit or distribute any content or material that is protected by copyright, trademark, privacy, or other personal or proprietary right, you must first obtain written permission from the owner of such a right.  You are solely liable for any damage resulting from any infringement of copyrights, trademarks, trade secrets, rights of privacy, or other personal or proprietary rights; or any other harm resulting from anything that you transmit to this Website, or to CFO’s Book, Podcast, or retreat Experience.

g)  By transmitting to this Website or any of CFO’s other resources, any question, story, content, video, photograph, slide, material, or any other information, you agree that you have the consent of each and every identifiable person to use such person’s name and/or likeness in the manner contemplated by CFO.  You also agree not to transmit or distribute any and all content, materials, photographs, slides, recordings, videos, and other information produced by you in the course of your employment by a third party.  You agree not to transmit or distribute any and all content, materials, photographs, recordings, videos, slides, films, and information that contain libelous or otherwise unlawful or abusive material (as determined at the sole discretion of CFO); including any statements which may defame, harass, stalk, or otherwise threaten others.  You agree not to transmit or distribute any content, materials, and information that contain or promote obscenities (as determined at the sole discretion of CFO); including any content or material containing or promoting pornography, pedophilia, bestiality, or incest; or that may be offensive to other subscribers/users/participants in this Website, or any of CFO’s other resources; or that may be offensive to the online community in general; including, but not limited to, blatant expressions of profanity, vulgarity, hatefulness, bigotry, prejudice, racial bias, or racism.  The transmitting or distribution of any and all such content, materials, photographs, and information will cause the immediate blocking, banning, and cancellation of your account, and/or subscription, and/or registration, and/or participation in this Website and all of CFO’s other resources, meetings, conferences, events, retreats, and teachings linked to it; without appeal, and at the sole discretion of CFO.

h)  By transmitting to this Website or any of CFO’s other resources, any content, materials, photographs, recordings, videos, films, slides, or information, you agree not to transmit or distribute any material that violates any law (including any law governing the manner in which it was obtained or created); or to engage in any and all activities in the use of, or participation in, this Website, or any other CFO resource, or face to face meeting, that would constitute a criminal offense, or that would give rise to a civil liability.  You agree not to transmit or distribute any content, materials, photographs, recordings, videos, films, or information that advocates or provides instructions for any illegal activity.  You agree not to discuss illegal activities on this Website or in any other CFO resource or face to face meeting, or to subscribe/use/participate in these resources, or any CFO face to face meeting with the intent to commit an illegal activity.

i)  You agree not to transmit any content, materials, photographs, recordings, videos, films, slides, or information that contain any computer virus or other malicious code that could in any way affect the operation of this Website, or any other CFO resource, or any servers, computers, or other digital device or devices that are, or have been, connected to this Website or any other CFO resource.

9.  Legal Identification Requirements:  To access/use/participate in this Website, or any other CFO resources, as well as any future features, programs, pages, photographs, recordings, videos, slides, films, or services that CFO may introduce from time to time; you are/may be required to provide your legal and correct first and last name; a password of your choosing; and a valid email address.  CFO is, and will continue to be, unable to accept some Internet email accounts due to system incompatibilities.  CFO is not responsible for the privacy practices of any user, and you are responsible for maintaining the confidentiality of your own personal information.  You therefore agree that all actions taken by you, and/or by any other user who subscribes/accesses/uses this Website and all other CFO resources by using your personal information, will be attributed to you, and will be legally binding on you; even acts for which you have, or had, no actual authority; or which were made in error.  By subscription to, or registration on, or participation in, this Website and/or any of CFO’s other resources, you assume all resulting liabilities from accessing/using these resources; and for any and all of the other programs, event, retreats, services, recordings, videos, slides, photographs, films, features, products, Bible paraphrases, Spiritual principles, and any and all other postings and pages available on this Website and CFO’s other resources. You acknowledge that CFO may not be able to, and does not have the ability to, prescreen in their entirety all the content, materials, photographs, recordings, videos, films, and information on this Website and CFO’s other resources; and that CFO and its designees reserve the right to (but not the obligation to) at their sole discretion, refuse, delete, or move any content, materials, photographs, and information of any kind on this Website or in any of CFO’s other resources. You also acknowledge that you may be exposed to content, materials, photographs, videos, slides, films, and information on this Website and CFO’s other resources that you may find personally offensive or objectionable.  But you agree that your subscription/access/use of CFO’s resources constitutes your acknowledgment that you will personally bear and accept any and all personal risk, injury, or harm associated with, or that may be associated with, such content, materials, photographs, recordings, videos, slides, films, and information.  You agree not to submit to, or post on, transmit, or distribute through this Website or any other CFO resource, any unlawful, harmful, threatening, terroristic, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, racially, ethnically, or otherwise objectionable material of any kind; including, but not limited to, any material that encourages conduct that would constitute a criminal offense, or gives rise to a civil liability, or that would otherwise violate any applicable local, state, national, or international law; or that would violate the terms of this Privacy and Terms Contract.  You agree not to submit to, to post on, to transmit, or to distribute, through this Website, or any other CFO resource, any materials, CDs, DVDs, recordings, videos, slides, flash drives, or other devices that contain software viruses, corrupted files, or any similar software or programs that may damage or adversely affect the operation of another person’s computer and/or the operation of this Website or any other CFO resource.  You agree not to submit to, post on, transmit, or distribute, through this Website or any other CFO resource, any political solicitation or political campaigning; or any commercial solicitation; or any chain letter; or any mass mailing; or any form of “spam.”  You agree to provide accurate, current, correct, and complete information about yourself and/or all other persons mentioned in your communications; and you will not, and may not, use a false email address, impersonate another person or entity, misrepresent your affiliation with another person or entity, and otherwise mislead The Christian Family Online in America, Inc., as to the origin of your transmitted or distributed content, material, or information.  Finally, CFO agrees and covenants that it will not post or otherwise publish on this Website or any other CFO resource any question submitted by you, or any answer composed by CFO in response to such a question by you, without first obtaining your written permission by Text, Email, USPS Mail, Social Media, or some other method of communication.

10.  Non-Endorsements:  In the event that any third party links to this Website, or any other CFO resource, that fact does not necessarily constitute an endorsement, adoption, authorization, sponsorship, affiliation, joint venture, or partnership by, or with, CFO.  In most cases, CFO will be unaware that a third party has linked to this Website or any of its other resources, and therefore CFO has no responsibility or obligation to endorse, or not endorse, such a party, or such a party’s ideas, products, services, programs, or activities.

11.  Non-Confidentiality:  CFO does not intend to, nor does it desire to, receive confidential or proprietary content, materials, photographs, recordings, videos, slides, films, or information from you.  If you transmit to this Website or any of CFO’s other resources any material, content, recording, video, photograph, slide, data, information, or idea, it will be treated as non-confidential and non-proprietary; and CFO will be free to reproduce, publish, or otherwise use it within the terms and conditions of these Privacy and Terms conditions; except that nothing herein will act to reverse or alter the terms and conditions of this Contract, as described in, and included in, this Contract.

12.  Exclusive Ownership and Copyright Terms:  Pursuant to, and as an extension of, Clause 7 of this Privacy and Terms Contract, all of the content and material on this Website, and in The Book, The Podcast, The Experience, and any and all other CFO resources, together with any and all photographs, documents, text, audio and video recordings, films, slides, and all other materials related to the Website and all of CFO’s other resources, are the exclusive property of CFO, and are protected by United States Domestic, Pan-American, and International Copyright Laws, Treaties, and Agreements.  This includes the “compilation” and the “look and feel” of the copy, content, photographs, slides, PDFs, recordings, videos, films, and all other such materials on this Website and all of CFO’s other resources.

13.  U.S. Laws:  This Website, and any and all other CFO resources, meetings, conferences, events, retreats, and teachings linked to it, are sponsored by, and operated by, The Christian Family Online in American, Inc., at its offices in the United States of America.  CFO makes no representation that any, or all, of the content, materials, photographs, recordings, videos, slides, films, and other information on these resources, or in its meetings, conferences, events, retreats, or teachings, are appropriate to use, or available for use, in any other jurisdiction.  Accessing/using/participating in/subscribing to these resources, and/or participating in any other CFO event in jurisdictions where such activities are illegal, is hereby prohibited.  If you choose to access/use/participate in/subscribe to these resources, or participate in a CFO event, retreat, meeting, or activity in any other jurisdiction, you do so on your own initiative and at your own risk; and you are responsible for compliance with any and all applicable local, national, and international laws.  CFO and its affiliated or related entities, directors, officers, employees, and agents, is/are not responsible for any violation of any such law or laws in any other such jurisdiction.  You also may not use, export, transmit, or distribute any of CFO’s resources, content, materials, photographs, recordings, videos, slides, films, and other information on this Website or any other CFO resource in violation of any export law or regulation of the United States of America.

14.  Changes to Contract:  CFO may change the terms and conditions of this Privacy and Terms Contract from time to time at CFO’s sole discretion.  Such changes may result from internal changes/revisions to the Website or CFO’s other resources; or in response to changes/revisions in local, state, national, or international laws; or from changes/revisions in calendar dates and/or time zones; or from any other reason whatsoever.  Such changes/revisions to this Contact are, and will be, effective immediately upon posting them on this Blog and Podcast.  Your continued access/use of this Website and any or all of CFO’s other resources, and/or your continued participation in any CFO event, retreat, or meeting constitutes your assent to such changed/revised terms, as well as your agreement to be bound by them.  CFO may, but is not obligated to, provide you with notice of such changes/revisions to this Contract by Text, Email, USPS Mail, Social Media, or any other form of communication.  You can determine whether or not the terms of this Contract have been changed/revised by reading the “Version” date at the top of this Contract.  To the extent that there is a conflict or inconsistency between the terms in the body of this Contract and any future change, revision, amendment, addendum, or text incorporated herein, the terms of such change, revision, amendment, addendum, or text will prevail.

15.  Indemnification of CFO:  You hereby jointly and severally agree to indemnify, defend, and hold The Christian Family Online in America, Inc., as well as any of its affiliated or related entities; and any of its directors, officers, agents, employees, information providers, licensors and licensees, collectively harmless from, and against, any and all liabilities and costs; including, but limited to, attorney’s fees and costs incurred by the indemnified parties in connection with any claim arising out of your access/use of this Website and all other CFO resources, or your participation in any CFO meeting, conference, teaching, retreat, or other event; and/or any breach by you of the terms of this Privacy and Terms Contract; including any liabilities associated with any violation of local, state, or federal laws.  If the indemnity provided in this paragraph is not available, or is insufficient to hold harmless the indemnified parties for any reason, you agree to contribute to the aggregate losses, claims, and liabilities to which the indemnified parties may be subject, in such proportion as appropriate to reflect the relative fault by you and the indemnified parties with respect to the activity giving rise to the indemnity claim; and you will cooperate fully and reasonably in the defense of any such claim.  CFO reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you; and you will not in any situation settle any such matter without the prior written consent of CFO.

16.  Third Party Rights:  Some of the terms of this Privacy and Terms Contract are for the benefit of CFO and its subsidiaries, affiliates, directors, officers, employees, agents, licensors, and suppliers.  Each of these individuals or entities has, and will have, the right to assert and enforce any or all such terms directly against you, on his, her, or its own behalf.

17.  Termination by Removal or Banning:  This Privacy and Terms Contract may be terminated by either party without notice, at any time, for any reason, with or without a stated cause.  However, CFO can terminate this Contract in either of two ways:  First, by temporarily removing subscribers and/or users and/or participants who can be reinstated later at their request, and at the sole discretion of CFO.  Second, by permanently banning subscribers and/or users and/or participants who cannot be reinstated by either party for any reason.  Subscribers and/or users and/or participants who are terminated by removal or by banning may no longer access or use this Website, or any other CFO resources, or participate in any CFO meeting, event, retreat, conference, or teaching after being terminated; except that in the case of a removal, the user and/or participant can regain access to the Website and other CFO resources if reinstated by CFO.  Certain appropriate Clauses, Paragraphs, and Sentences of this Contract do, and will, survive such terminations, as decided by CFO at its sole discretion.

18.  Governing Laws:  The stipulations in this Privacy and Terms Contract, including all revisions and amendments to it, will be governed by the Laws, Statues, and Codes of the United States of America, the State of North Carolina, the County of Guilford, and the City of Greensboro, without regard to any conflict or legal decision that would imply the potential use or application of the laws of any other city, county, state, national, or international jurisdiction.

19.  Binding Arbitration:  By subscribing to/accessing/using this Website or any of CFO’s other resources, and/or participating in any CFO meeting, conference, event, retreat, or teaching, in any way, at any time, you unconditionally consent and agree that the Laws, Statues, and Codes of the United States of America, the State of North Carolina, the County of Guilford, and the City of Greensboro, will govern and adjudicate the terms of the Privacy and Terms Contract.  You also unconditionally consent and agree that:

a)  Any claim, dispute, or controversy (in contract, tort, or otherwise) that you may have against the directors, officers, employees, or agents of CFO or its subsidiaries or its affiliates, arising out of, or connected in any way with, this Website any other CFO resource; or the determination of the scope or applicability of The Christian Family Online in America, Inc., to arbitrate, will be resolved exclusively by final and binding arbitration administered by the Judicial Arbitration and Mediation Services, Inc. (JAMS); as conducted before a sole arbitrator, in accordance with the rules of JAMS.

b)  Such a JAMS arbitration agreement is made pursuant to a transaction involving interstate commerce, and will be governed by the Federal Arbitration Act (FAA):  9 U.S.C. §§ 1-16.  The arbitration shall be held in Atlanta, GA or any other suitable location as decided by the JAMS arbitrator.

c)  Such a JAMS arbitrator’s decision will be controlled by the terms of this Privacy and Terms Contract, as well as by any and all other agreements referenced herein that a user may have entered into in connection with this Blog and Podcast, or any meeting, conference, teaching, or event connected to it.

d)  Such a JAMS arbitrator will apply the laws of the United States of America, the State of North Carolina, the County of Guilford, and the City of Greensboro, as consistent with the FAA’s and applicable statutes of limitations, and will honor claims of privilege recognized at law.

e)  There will be no authority for any claims to be arbitrated on a class or representative basis, and such a JAMS arbitrator can, and will, decide only your and/or the applicable CFO entity’s individual claim.  The JAMS arbitrator may not consolidate or join the claims of other persons or parties who are, or may be, similarly situated.

f)  Such a JAMS arbitrator will not have the power to award punitive damages against you, or any CFO entity.

g)  In the event that administrative fees or deposits in excess of $125.00 USD must be paid to initiate any JAMS arbitration against any CFO entity, and you are unable to pay such fee or deposit (or are not required under the rules of JAMS to pay it), CFO agrees to pay such fee or deposit and to forward it on your behalf, subject to ultimate allocation by the arbitrator.  In addition, if you are able to demonstrate that such costs of arbitration will be prohibitive as compared to the costs of litigation, CFO will pay your filing and hearing fees in connection with the arbitration, as such a JAMS arbitrator deems necessary to prevent the arbitration from being cost-prohibitive.

h)  With the exception of Paragraph “e” above, if any part of this arbitration provision is deemed invalid, unenforceable, or illegal; or otherwise conflicts with the rules of JAMS, the balance of this arbitration provision shall remain in effect and shall be construed in accordance with this provision, as if the invalid, unenforceable, illegal, or conflicting part was not contained herein.  However, if Paragraph “e” above is found to be invalid, unenforceable, or illegal, then the entirety of this arbitration provision will be null and void, and neither you, nor CFO, will be entitled to arbitration in a dispute.

20.  Miscellaneous Terms:  CFO’s failure to insist upon, or to enforce, the strict performance of any or all of the terms and conditions of this Privacy and Terms Contract will not be, and cannot be, construed as a waiver of any of this Contract’s provisions and rights.  Neither the course of conduct between the parties, nor any trade practice, will act to modify any term of this Contract.  CFO may change, suspend, or discontinue any aspect or feature of this Website or any other CFO resource, or of any CFO face to face meeting, event, retreat, service, activity, program, or product linked to this Website or any of CFO’s other resources or its face to face meetings, at any time, and for any reason.  CFO reserves the right to change/revise system configurations; service specifications; upgrades; layouts; options; meeting places; meeting times, and/or any other aspect of this Website and its other resources, and/or any CFO meeting, event, retreat, conference, or teaching at any time, in any place, without any notice.  CFO may also impose limits or restrictions on certain services, activities, features, content, or meetings; or may restrict your access to all or any part of this Website or any of its other resources, or any CFO face to face meeting linked to this Website or its other resources, without notice or liability.  CFO may be required by local, state, or federal laws to notify you of certain events; and you hereby acknowledge and agree that such notices will be effective upon CFO posting them on this Website or any of CFO’s other resources; or by delivering them to you through Text, Email, Social Media, or the USPS Mail Address that CFO has for you.  CFO cannot be, and will not be, held liable if it fails to notify you of such changes by these, or by any other system of communications.  You agree that, regardless of any statute, code, or law to the contrary, any claim or cause of action that you may have under this Contract arising out of, or related to, any subscription to/access of/use of this Website of any other CFO resource, or any participation in or attendance of any CFO face to face meeting linked to this Website or CFO’s other resources, must be filed within six (6) months of the specific and verifiable date that such a claim or cause of action arose; or such a claim or cause of action is, and will be, forever barred.

21.  Relationship of Parties:  The terms, stipulations, and conditions set forth in this Privacy and Terms Contract do not create a partnership, franchise, joint venture, agency, fiduciary, or employment relationship between any of the parties involved.

22.  No Waiver and Cumulative Remedies:  No failure, or delay, by either party in exercising any right under the terms of this Privacy and Terms Contract will constitute a waiver of that right.  CFO may waive a term or condition of this Contract only by non-electronic writing, signed by an authorized representative of CFO.  Unless expressly stated otherwise elsewhere in the terms and conditions of this Contract, all rights and remedies provided in it are cumulative and are not exclusive of any other rights or remedies that may be available to you, or to CFO; whether provided by law, equity, statute, code, or otherwise.

23.  Severability:  If any term or condition of this Privacy and Terms Contract is held by a court of competent jurisdiction to be unlawful, void, or for any other reason unenforceable, that term or condition shall be deemed severable from this Contract and will not affect the validity and enforceability of any of this Contract’s remaining terms or conditions.  Any term or condition in this Contract that is held unlawful, void, or for any reason unenforceable, will be modified by the court and interpreted in a manner that will best accomplish the objective of the original intent of the Contract to the fullest extent permitted by law.

24.  Attorney’s Fees:  You will pay on demand all of CFO’s reasonable attorney fees, as well as the costs incurred in collecting any fees or charges due CFO under the terms of this Privacy and Terms Contract, following any breach by you of this Contract.

25.  Notification Address:  Notices sent to CFO, as well as requests for copyright permissions, and other comments and requests, may be sent by USPS Mail to CFO’s designated agent:

26.  CFO is a 501(c)(3) Public Charity:  This Website, The Book, the Podcast, and The Experience, together with all meetings, events, retreats, conferences, teachings, and other activities linked to this Website, is owned and operates by The Christian Family Online in American, Inc.; also known in this Contract as Christian Family Online, or as CFO.  CFO is a Christian ministry that was incorporated as a domestic non-profit Corporation under the Laws of the State of North Carolina on April 20, 2000.  On September 1, 2000, the Internal Revenue Service (IRS) granted CFO temporary tax-exempt status as a Public Charity (Click Here to See That Letter).  On January 4, 2001, the State of North Carolina granted CFO permanent tax-exempt status as a Public Charity (Click Here to See That Letter).  On March 23, 2005, the IRS granted CFO permanent tax-exempt status as a Public Charity (Click Here to See That Letter).  Accordingly, CFO is a fully and legally qualified Public Charity in good standing with both the Internal Revenue Service and the State of North Carolina.

27.  CFO Is Non-Political:  Pursuant to, and in extension of, Clause 9 of this Privacy and Terms Contract, in its legal status as a non-profit public charity, CFO cannot, and will not, sponsor or support any politician or political party.  Article 9 of CFO’s Charter reads in part: “This Nonprofit Corporation will never, as part of its activities, carry on Propaganda, nor otherwise attempt to influence Legislation … nor will it ever participate in, or intervene in, any Political Campaign on behalf of, or in opposition to, any Candidate for Public Office.”  This statement in CFO’s Charter defines CFO’s purpose as Non-Political.  Accordingly, by subscribing to/accessing/using this Website or any of CFO’s other resources, and/or by participating in, or attending, any CFO meeting, event, retreat, conference, or teaching, you agree not to post on CFO’s Website, or CFO’ social media, or distribute at any CFO meeting, event, retreat, or teaching, any political statement, comment, slogan, motto, or other comment; and you agree not to engage any other user/subscriber/registered person on this Website or any other CFO resource, in any political debate, dispute, disagreement, or argument at any time, in any place; either on the pages of this Website or any other CFO resource, any meeting, event, retreat, conference, teaching, or other activity hosted by, sponsored by, or operated by, The Christian Family Online in America, Inc.

28.  CFO is Interdenominational and Non-Denominational:  Article 3 of CFO’s Charter reads in part that CFO’s purpose is to:  “… research, develop, promote, improve, and maintain a group of quality interdenominational Internet programs … for the purpose of Christian Spiritual Growth through the teachings and values of the Early Christians in the First and Second Centuries.”  In compliance with Article 3, CFO is now, and will continue to be, a Christian domestic ministry that hosts and sponsors its activities to the members/attendees of any and all Denominational, Non-Denominational, or Independent Congregations of Christians.  CFO offers now, and will continue to offer, this Website, The Book, The Podcast, and The Experience, as well as meetings, events, retreats, conferences, teachings, and other activities, to all unaffiliated Christians (Christians who do not attend any formal Christian congregation); as well as to all Non-Christian persons (persons who are members of other religions; or who are not members of any religion; or who profess to be atheists or agnostics).  In compliance with Article 3, CFO’s mission is to teach all people, regardless of whether they attend a Christian congregation; or are a dropout from one; or have never attended one; or who are atheists or agnostics, or who are members of another religion.  Accordingly, all of the terms and conditions of this Privacy and Terms Contract apply to any and all of these people and groups of people, whenever and wherever they subscribe to/access/use this Website or any of CFO’s resources, and/or whenever and wherever they participate in any CFO hosted and/or sponsored meeting, event, retreat, conference, teaching, or small group linked to this Website or any other CFO resource.

29.  CFO as a Sponsor of Para-Groups:  Pursuant to, and in extension of, Clause 1 of this Privacy and Terms Contract, CFO will, from time to time and in place to place, engage in, and implement the forming, developing, and teaching of small groups known as “Para-Groups.”  (“Para-Groups” are defined as small groups of Christians formed by a parent Christian congregation to meet outside of, and independent of, the parent congregation’s authority and control.)  CFO’s teaching of these Para-Groups will be linked by Internet to this Website and CFO’s other resources, and will require subscription/access/use of its teaching resources, content, materials, photographs, recordings, videos, slides, films, content, ideas, suggestions, concepts, Bible paraphrases, and Spiritual principles.  Accordingly, all the terms and conditions of this Privacy and Terms Contract apply to the attendees/participants of CFO’s Para-Groups in the same way that they apply to Internet-only users/participants.  By being an attendee/participant in any CFO Para-Group, you are unconditionally acknowledging, consenting, and agreeing that this Website and all the other CFO resources are the source of the teachings you are receiving, and that all the terms and conditions of this Contract apply to you with full force and effect; and that you are unconditionally consenting and agreeing that you are, and will, submit to, and comply with, all of the terms and conditions of this Contract.
